Russia EAC Certificate - What Does The New Legislation Say?


Russia GOST certificate was prevalent once for products needing to meet Custom’s Unions standard in the country. Now, it has more or less been replaced by the EAC certification.

It’s a new set of standards applicable for the five Eurasian countries: Russia, Belarus, Armenia, Kazakhstan and Kyrgyzstan.

The legislation was not introduced all of a sudden. In fact, a three years time frame was set up in 2013, for enforcement over diverse sectors.

Compared to GOST-R certificate, the process of acquiring the EAC certificate is different in many aspects. Let’s start with the basics:

Application

The first and a significant difference is that foreign manufacturers must have their request supported by a representative that is already established in Eurasian Customs Union territory. This means that a manufacturer can’t independently apply for the EAC certificate of conformity unless they are registered in one of the ECU countries.

The applicant may be a subsidiary of the producer, distributor, importer or a representation service provider company for certification purposes. The representative’s name goes on the certificate, and they are entitled to use the document as well as authorize its use by entities such as the manufacturer, through a proxy.

Issuance

During the issuance procedure, the verification step is significantly different.

Depending on the type of product, it may require the possibility of the product to be easily transported, validity of the certificate, inspection and testing at the production facility or shipment of samples to laboratory.

Documentation analysis procedure remains same.

It may take a minimum of two weeks for the certificate to be issued. It depends on the technical regulations that are applicable, completeness of the submitted documents and cooperation provided by the representative.

Certificate and use

The certificate is delivered on official paper, and a copy is generally attached to the case file that is required for customs clearance. The original certificate or a copy must also be shown to relevant authorities, if requested.

The use of the certificate is not limited to business transactions with your representative. You can use it for all applicable transactions under the applicant’s proxy provision included in the rules.

Finally, the certificate validity may not extend beyond five years.
